The city medical examiner has ruled the death of Eric Garner, the 43-year old father who died in police custody last month, a homicide, saying a chokehold caused his death according to CBS News.

The medical examiner spokeswoman Julie Bolcer said “the compression of his chest and prone positioning during physical restraint by police” in the July 17 incident in Staten Island, was what killed the unarmed man.

Garner’s asthma, obesity and hypertensive cardiovascular disease were also contributing factors, Bolcer determined.

Officer Daniel Pantaleo, who put Garner in the illegal chokehold, has been stripped of his gun and badge awaiting an internal NYPD investigation and another unidentified police officer has also been placed on desk duty. Two paramedics and two EMTs were suspended without pay after allegedly deteriorating to provide CPR in a timely manner.

    Is this afternoon’s homicide ruling just a hollow victory for the memory of Eric Garner and his family? By calling Eric Garner’s death a homicide aren’t we really just placating the frayed nerves of a society ever distrustful of those who have been asked to serve and protect us?

    Do we really now expect the DA to bring criminal charges against the NYPD and open a floodgate of other potential cases? Do we really expect profiling, selective treatment towards persons of interest to suddenly change and what is it about the way the NYPD which allows it to go about believing it’s above the very law that it is asked to serve?
