A man who almost died in a shootout with cops was sentence to 40 years in prison on Friday, which is the maximum sentence permitted under the law.

“He chose to engage in a shootout where, miraculously, no one was killed,” Brooklyn Supreme Court Justice Dineen Riviezzo said.

Last month, Jerry Benoit, 33, was convicted of attempted aggravated assault for shooting at police in September 2011. However, according to the Daily News, he was cleared of the top counts of attempted murder.

“We are pleased today this judge saw fit to send this mope to the maximum sentence,” said Patrick Lynch, boss from Patrolmen’s Benevolent Association.
