At the height of a controversial law suit between the Marvin Gaye estate, Pharrell Williams, Robin Thicke and now T.I and Interscope/Universal Music Group, another lawsuit has risen. Mac Miller is being sued by 1970s funk band Aquarian Dream for using a portion of their song “Yesterday (Was So Nice Today)” for his mixtape Faces.
TMZ reports that band member Jacques Burvick filed the lawsuit forward after hearing Mac Miller’s Faces track “Therapy” which samples the band’s song. He also claims that Miller’s camp knew of the sample infringement and even reached out to the band to secure an official “ok” for using the sample.
Aquarian Dream is seeking $150,000 in damages, citing more than 700,000 downloads of the mixtape. But this isn’t Miller’s first time being taken to court over his choice in sampling. In 2012, Lord Finesse tried to sue Mac Miller for $10,000,000 after he used the “Hip 2 Da Game” production without permission. That case was later settled shortly after the filing.
