The District Attorney in Berkely County, South Carolina has concluded that he county officials must honor the plea agreement struck between them and Charalamagne Tha God in 2001 in his contributing to the delinquency of a minor charge.
According to Solicitor Scarlett Wilson,
“the State allowed Mr. McKelvey to plead guilty to Contributing to the Delinquency of a Minor and agreed to dismiss the remaining charge.”
Wilson said that the state is required by law to honor that agreement and that the case could not be “resurrected” or tried in double jeopardy, which is against federal law.
The alleged victim, Jessica Reid, was 15 at the time of the incident in 2001. Wilson said that the Power 105 personality was able to garner the agreement with the county because of the “victim’s absence and lack of evidence available at the time.”
Reis, now 32, has been trying to reopen the case with claims that she was raped by Charlamagne.
According to the state of Sooth Carolina, Tha God is “innocent of the dismissed allegation.”
