Even though former Dallas Police officer Amber Guyger was convicted for the murder of her neighbor Botham Jean in their Dallas apartment complex, but a judge found that the Texas metropolis should not be held responsible for his death.

Jean’s family filed an appeal last week, citing that the city of Dallas should be held accountable in some regard, but a judge dismissed the city from the lawsuit, while Guyger’s name remains on the lawsuit.

The Jean family lawyer Daryl Washington said, “To get this news the day after Christmas was very difficult for the family. They know we have a fight ahead of us. And they’re just prepared to do whatever it takes to get some type of justice for Botham and their family.”

Guyger was convicted earlier this year of shooting and killing Jean in his own apartment when she mistakenly walked in thinking it was her apartment.

Amber Guyger will be eligible for parole in just four years.
