Jan. 6 Defendant Pardoned by Trump Sentenced on Child Abuse Charges

Family of Capitol Rioter Who Was Killed During Insurrection To Sue Capitol Police For $10 million

A man previously pardoned by Donald Trump for his involvement in the January 6 Capitol attack has been sentenced in a separate federal case involving child sexual abuse material.

Daniel Tocci was sentenced to four years in prison by Mark G. Mastroianni after pleading guilty to possession of more than 100,000 illegal images and videos, according to the U.S. Department of Justice.

Authorities said the material was discovered during an investigation tied to Tocci’s Capitol riot case, which was later dismissed following Trump’s clemency for roughly 1,500 defendants. According to NBC News, prosecutors also revealed Tocci’s laptop contained additional disturbing, violent content unrelated to the charges.

Tocci’s defense previously argued the case should be dismissed, claiming the evidence stemmed from a warrant connected to the pardoned Jan. 6 investigation. However, the court allowed the case to proceed.

The Justice Department did not reference the Capitol riot in its sentencing announcement, focusing solely on the child exploitation charges. Tocci’s sentence closes a case that drew attention due to its connection to one of the most widely scrutinized events in recent U.S. history.
