
Despite releasing new music in 2025, Fivio Foreign has actually been behind bars since January 18, a fact that recently came to light through his attorney, Adam Lustberg. While fans assumed the Brooklyn rapper was continuing business as usual with collaborations alongside Plaqueboymax and Caldwell, it turns out these verses were recorded before his arrest.
Lustberg confirmed to TMZ that Fivio is facing five charges stemming from an alleged incident on New Year’s Day in New Jersey. According to reports, a woman approached the rapper for a jumpstart after her car died. She claims that instead of helping, he brandished a firearm and issued a threat.
“If I see you parked in front of this building again, there’s going to be a f***in problem,” Fivio allegedly said. Witnesses reportedly recognized the rapper, known for his work with Kanye West, and called the police. He was later arrested and charged with unlawful possession of a weapon, aggravated assault, terrorist threats, and two additional offenses.
Surveillance footage reportedly places Fivio near the scene of the confrontation, adding weight to the prosecution’s case. However, Lustberg remains confident, telling TMZ that the charges are weak and stating that no firearm was recovered from his client. “This is the flimsiest case I’ve seen in my 20 years of practice,” the attorney claimed, suggesting that Fivio could be free within a few months.
This isn’t Fivio Foreign’s first run-in with the law. In 2021, he was arrested in New Jersey for carrying a loaded, defaced firearm and attempting to flee from police. He has also been vocal about law enforcement’s treatment of drill rappers, expressing frustration over what he sees as unfair scrutiny.
“This the drill community, and I know like, the police and everybody be looking at n***as,” he said during a Palms meeting. “Like n***as is starting trouble, but n***as ain’t really starting trouble. They tryna feed they kids.”
As the legal process unfolds, fans will be watching closely to see if Fivio Foreign can clear his name and return to music.
